Terms and Conditions

These Terms and Conditions apply to all contracts between Mohammad Areesheh, Connollystr. 3, 80809 Munich, Germany (hereinafter 'Provider') and the customer (hereinafter 'Participant') regarding participation in online German courses as well as free and paid digital content offered in the 'Library' via the website https://areesheh.com.

Any different conditions from the Participant will not be recognized unless the Provider expressly agrees to their application in writing.

These Terms and Conditions apply to both consumers and businesses unless a differentiation is made in the respective clause.

The display of courses on the website does not constitute a legally binding offer, but rather an invitation to submit an offer.

The Participant makes a binding offer to conclude a contract by completing the booking process.

The contract is concluded when the Provider accepts the registration by sending a confirmation email.

The contract language is German.

The Provider offers online German language training for Arabic speakers. Courses are held as live, instructor-led group classes.

In addition, the Provider operates a free learning app ('DeutschQuiz') at quiz.areesheh.com for practicing the German language. DeutschQuiz is a free, ad-supported offering and is not part of the paid course contracts. DeutschQuiz can be used without registration or course enrollment.

DeutschQuiz is partially financed through advertisements (Google AdSense). Details about data processing in connection with advertising can be found in our Privacy Policy.

Under the 'Library' area, the Provider also offers free and paid digital content such as ebooks, PDFs, audio files, and companion download packs. The exact scope of services is determined by the relevant product page.

DeutschQuiz includes a grammar trainer ('der/die/das Trainer') for practicing German articles in various game modes (Speed Round, Endless, Sudden Death, Learn). Registered users can save words and compare their progress on a global leaderboard. The trainer features optional 'Rewarded Ads' – video advertisements that users may voluntarily watch to receive in-app benefits. Watching these ads is entirely voluntary and has no effect on game progress.

The exact scope of services (course level, duration, dates, group size) is determined by the course description at the time of booking.

The Provider reserves the right to reschedule dates for important reasons (e.g., instructor illness). In this case, an alternative date will be offered.

The minimum and maximum number of participants is specified in the course description. If the minimum number is not reached, the Provider reserves the right to cancel the course. In this case, the full course fee will be refunded.

The Provider offers the option to be placed on a notification list for future courses without obligation. This does not constitute a right to the realization of a course or subsequent participation.

Areesheh Academy courses are supplementary, instructor-led live group classes (virtual classroom instruction) designed to strengthen German language skills (language training/Nachhilfe). All instruction takes place synchronously and interactively via Microsoft Teams.

The courses do not constitute distance learning as defined by the German Distance Learning Protection Act (Fernunterrichtsschutzgesetz – FernUSG), as all instruction is delivered exclusively as synchronous, instructor-led live group classes.

No certificates, diplomas, or formal qualifications are issued. The courses are not official exam preparation courses and do not lead to any government-recognized qualifications.

The courses do not replace integration courses (BAMF), professional language courses, or other government-funded language programs.

The Provider offers a paid premium subscription called 'DeutschQuiz Plus' for the DeutschQuiz app. DeutschQuiz Plus unlocks additional features including: unlimited hearts, ad-free usage, exam mode access, double rewards (1.5x XP and 2x coins), and unlimited AI pronunciation training.

DeutschQuiz Plus is available as a monthly subscription ($4.99/month) or an annual subscription ($29.99/year, equivalent to $2.50/month). All prices are final prices and include statutory VAT.

The subscription renews automatically for the selected term (1 month or 12 months) unless cancelled before the end of the current billing period.

A free trial may be offered when subscribing to the annual plan. After the trial period, the regular annual subscription price will be charged automatically unless cancelled before the trial ends. The exact trial duration is displayed during the purchase process.

Cancellation is possible at any time. Cancellation takes effect at the end of the current billing period. No pro-rata refund is provided for the remaining billing period.

On the website (web version), payment is processed via the payment service provider Stripe. In the native app (iOS/Android), payment is processed via the respective app store (Apple App Store / Google Play Store) through RevenueCat.

The Provider reserves the right to expand or adjust the features of DeutschQuiz Plus, provided the essential service content is maintained. Price changes will be announced at least 30 days in advance and will only take effect from the next billing period.

DeutschQuiz offers AI-powered learning features that utilize third-party services. These features include: (1) Speech recognition and pronunciation training via Microsoft Azure Speech Services, (2) AI Dialogue Partner for practicing everyday conversations via Anthropic Claude, (3) AI text-to-speech via ElevenLabs for natural voice output.

The AI-powered features serve exclusively as practice tools and do not replace professional language instruction. The Provider does not guarantee the accuracy of AI-generated responses, corrections, or assessments.

Use of the speech recognition feature requires granting microphone permission in the browser or app. Audio recordings are processed exclusively in real-time and are not permanently stored.

Use of AI features is subject to daily usage limits: Premium users (DeutschQuiz Plus) receive extended usage quotas, while free users receive a limited quota. The exact limits may be adjusted by the Provider.

Free users receive native browser text-to-speech instead of ElevenLabs AI text-to-speech. ElevenLabs AI text-to-speech is available exclusively to DeutschQuiz Plus subscribers.

The user agrees not to enter sensitive personal information (e.g., health data, financial information, passwords) in AI interactions. Conversation content is not permanently stored. Details about data processing can be found in our Privacy Policy.

The 'Library' includes free and paid digital products such as ebooks, PDFs, audio files, and companion ZIP files. Description, language, file format, price, and access model are determined by the relevant product page at the time of request or purchase.

Delivery is digital, either through a user account or via a secure, time-limited access link sent to the email address provided by you.

Library content is provided exclusively for your personal, non-transferable use. Sharing, public distribution, resale, sublicensing, uploading to third-party platforms, or circumventing technical protection measures is prohibited.

To protect paid content and prevent misuse, the Provider may personalize files (for example by adding watermarks or reference markings) and log secure download operations.

In the event of refunds, chargebacks, misuse, or justified suspicion of unlawful sharing, the Provider may suspend or revoke access to the affected Library product after review.

All prices listed are final prices and include statutory VAT (if applicable).

Payment for courses and paid Library products is made before access is provided via the payment service provider Stripe. Available payment methods are displayed during the checkout process.

For DeutschQuiz Plus, the prices and payment terms specified in § 3b apply. Billing occurs monthly or annually depending on the selected plan via Stripe (web) or the respective app store (native app).

Free Library resources are offered without charge, but for security reasons they may require the submission of an email address or sign-in before access is issued.

In case of late payment, the Provider is entitled to refuse participation in the course or access to DeutschQuiz Plus until payment is received.

The Provider may offer discount codes and special promotions from time to time. These are subject to the following conditions:

Only one discount code can be redeemed per booking. Combining multiple discount codes is not possible.

Discount codes have an expiration date and are no longer valid after expiry. The expiration date is communicated upon receipt of the code.

Discount codes are non-transferable, cannot be combined with other promotions, and cannot be exchanged for cash.

The Provider reserves the right to modify or end promotional campaigns at any time without prior notice.

Attendance Discount: Participants who achieve an attendance rate of at least 90% in a completed course may receive a 20% discount code for their next course booking. This discount code is manually issued by the Provider and is valid for 60 days from the date of issue. There is no legal entitlement to the attendance discount.

Consumers have the right to withdraw from this contract within fourteen days without giving reasons.

The withdrawal period is fourteen days from the date of contract conclusion.

To exercise your right of withdrawal, you must inform us of your decision to withdraw from this contract by a clear statement (e.g., email).

Detailed withdrawal instructions and a sample withdrawal form can be found under the menu item 'Withdrawal Policy'.

For services where execution began with the express consent of the consumer before the expiry of the withdrawal period, the right of withdrawal expires upon complete fulfillment of the contract.

For DeutschQuiz Plus subscriptions, the right of withdrawal applies from the time of contract conclusion (subscription purchase). Details on subscription withdrawal can be found in our Withdrawal Policy.

For digital content in the Library, the statutory withdrawal rules set out in our Withdrawal Policy apply. Where the law allows the right of withdrawal for digital content to expire early, this only applies if the legally required declarations are obtained separately during checkout.

Regardless of the statutory right of withdrawal, the following cancellation conditions apply:

Cancellation 14 days or more before course start: 100% refund of course price

Cancellation 7-13 days before course start: 50% refund of course price

Cancellation less than 7 days before course start: No refund

Cancellation must be in writing (email). The date of receipt of the cancellation notice by the Provider is decisive.

As an alternative to cancellation, the Participant may designate a substitute participant or rebook to a later course (subject to availability).

The Participant agrees to attend course dates punctually.

There is no entitlement to make-up sessions or refunds for missed classes.

The Participant agrees not to share or copy course materials to third parties.

Recording of lessons by the Participant is only permitted with express permission from the Provider.

The Provider is fully liable for intent and gross negligence as well as for injury to life, body, or health.

In case of slight negligence of essential contractual obligations (cardinal obligations), the Provider's liability is limited to the foreseeable, typically occurring damage.

Any further liability is excluded.

The Provider is not liable for technical disruptions outside their sphere of influence (e.g., internet outage at the Participant's location).

The Provider processes the Participant's personal data in accordance with the General Data Protection Regulation (GDPR).

The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods.

The place of jurisdiction for all disputes is the Provider's registered office, to the extent permitted by law.

If individual provisions of these Terms and Conditions are invalid, the validity of the remaining provisions remains unaffected.
