§ 1 Scope
These Terms and Conditions apply to all contracts between Mohammad Areesheh, Connollystr. 3, 80809 Munich, Germany (hereinafter 'Provider') and the customer (hereinafter 'Participant') regarding participation in online German courses offered via the website https://areesheh.com.
Any different conditions from the Participant will not be recognized unless the Provider expressly agrees to their application in writing.
These Terms and Conditions apply to both consumers and businesses unless a differentiation is made in the respective clause.
§ 2 Contract Formation
The display of courses on the website does not constitute a legally binding offer, but rather an invitation to submit an offer.
The Participant makes a binding offer to conclude a contract by completing the booking process.
The contract is concluded when the Provider accepts the registration by sending a confirmation email.
The contract language is German.
§ 3 Description of Services
The Provider offers online German language training for Arabic speakers. Courses are held as live, instructor-led group classes.
In addition, the Provider operates a free learning app ('DeutschQuiz') at quiz.areesheh.com for practicing the German language. DeutschQuiz is a free, ad-supported offering and is not part of the paid course contracts. DeutschQuiz can be used without registration or course enrollment.
DeutschQuiz is partially financed through advertisements (Google AdSense). Details about data processing in connection with advertising can be found in our Privacy Policy.
DeutschQuiz includes a grammar trainer ('der/die/das Trainer') for practicing German articles in various game modes (Speed Round, Endless, Sudden Death, Learn). Registered users can save words and compare their progress on a global leaderboard. The trainer features optional 'Rewarded Ads' – video advertisements that users may voluntarily watch to receive in-app benefits. Watching these ads is entirely voluntary and has no effect on game progress.
The exact scope of services (course level, duration, dates, group size) is determined by the course description at the time of booking.
The Provider reserves the right to reschedule dates for important reasons (e.g., instructor illness). In this case, an alternative date will be offered.
The minimum and maximum number of participants is specified in the course description. If the minimum number is not reached, the Provider reserves the right to cancel the course. In this case, the full course fee will be refunded.
The Provider offers the option to be placed on a notification list for future courses without obligation. This does not constitute a right to the realization of a course or subsequent participation.
§ 3a Nature of Services and Scope
Areesheh Academy courses are supplementary, instructor-led live group classes (virtual classroom instruction) designed to strengthen German language skills (language training/Nachhilfe). All instruction takes place synchronously and interactively via Microsoft Teams.
The courses do not constitute distance learning as defined by the German Distance Learning Protection Act (Fernunterrichtsschutzgesetz – FernUSG), as all instruction is delivered exclusively as synchronous, instructor-led live group classes.
No certificates, diplomas, or formal qualifications are issued. The courses are not official exam preparation courses and do not lead to any government-recognized qualifications.
The courses do not replace integration courses (BAMF), professional language courses, or other government-funded language programs.
§ 4 Prices and Payment
All prices listed are final prices and include statutory VAT (if applicable).
Payment is made before the course begins via the payment service provider Stripe. Available payment methods are displayed during the booking process.
In case of late payment, the Provider is entitled to refuse participation in the course until payment is received.
§ 4a Discounts and Promotional Codes
The Provider may offer discount codes and special promotions from time to time. These are subject to the following conditions:
Only one discount code can be redeemed per booking. Combining multiple discount codes is not possible.
Discount codes have an expiration date and are no longer valid after expiry. The expiration date is communicated upon receipt of the code.
Discount codes are non-transferable, cannot be combined with other promotions, and cannot be exchanged for cash.
The Provider reserves the right to modify or end promotional campaigns at any time without prior notice.
Attendance Discount: Participants who achieve an attendance rate of at least 90% in a completed course may receive a 20% discount code for their next course booking. This discount code is manually issued by the Provider and is valid for 60 days from the date of issue. There is no legal entitlement to the attendance discount.
§ 5 Right of Withdrawal
Consumers have the right to withdraw from this contract within fourteen days without giving reasons.
The withdrawal period is fourteen days from the date of contract conclusion.
To exercise your right of withdrawal, you must inform us of your decision to withdraw from this contract by a clear statement (e.g., email).
Detailed withdrawal instructions and a sample withdrawal form can be found under the menu item 'Withdrawal Policy'.
For services where execution began with the express consent of the consumer before the expiry of the withdrawal period, the right of withdrawal expires upon complete fulfillment of the contract.
§ 6 Cancellation by Participant
Regardless of the statutory right of withdrawal, the following cancellation conditions apply:
Cancellation 14 days or more before course start: 100% refund of course price
Cancellation 7-13 days before course start: 50% refund of course price
Cancellation less than 7 days before course start: No refund
Cancellation must be in writing (email). The date of receipt of the cancellation notice by the Provider is decisive.
As an alternative to cancellation, the Participant may designate a substitute participant or rebook to a later course (subject to availability).
§ 7 Terms of Participation
The Participant agrees to attend course dates punctually.
There is no entitlement to make-up sessions or refunds for missed classes.
The Participant agrees not to share or copy course materials to third parties.
Recording of lessons by the Participant is only permitted with express permission from the Provider.
§ 8 Liability
The Provider is fully liable for intent and gross negligence as well as for injury to life, body, or health.
In case of slight negligence of essential contractual obligations (cardinal obligations), the Provider's liability is limited to the foreseeable, typically occurring damage.
Any further liability is excluded.
The Provider is not liable for technical disruptions outside their sphere of influence (e.g., internet outage at the Participant's location).
§ 9 Data Protection
The Provider processes the Participant's personal data in accordance with the General Data Protection Regulation (GDPR).

§ 10 Final Provisions
The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods.
The place of jurisdiction for all disputes is the Provider's registered office, to the extent permitted by law.
If individual provisions of these Terms and Conditions are invalid, the validity of the remaining provisions remains unaffected.
